HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.19031 of 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a direction to respondents Nos.4 to 8 not to interfere with the affairs of the petitioners in civil disputes. 2.

Heard and perused the material available on record. 3.

It is the case of the petitioners that they are the owners of the subject property and the respondents in the name of investigation are interfering with the personal liberty and property of the petitioners. 4.

Learned Government Pleader for Home submitted that three cases were registered against the petitioners viz., Crime Nos.34 of 2016, 203 of 2016 and 366 of 2016 and that the police are investigating into the said crimes, as they disclose cognizable offences and they are not interfering in any of the civil disputes of the petitioners in respect of the subject property. 5.

Learned Counsel for the petitioners submitted that even though in earlier round of litigation, similar type of complaints were investigated and the same were closed as civil nature, again the present complaints were registered on the same set of allegations only to harass the petitioners herein.

In view of the above submissions, the respondents are directed to take note of the closure of earlier complaints during the course of investigation in the present crimes and complete investigation in accordance with law. If the said complaints registered against the petitioners disclose that the same has arisen out of the civil disputes between the parties concerned, the respondents are directed to complete

investigation and file a final report, without arresting the petitioners. The petitioners are also directed to appear before the respondents-authorities concerned, as and when required and produce all relevant documents to establish their right over the subject property. 7.

With the above directions, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
