HON'BLE SRI JUSTICE A. SHANKAR NARAYANA Tr.C.M.P.No.468 OF 2015 ORDER:

The present transfer petition, under Section 24 of the Code of Civil Procedure, 1908, is filed seeking to withdraw H.M.O.P.No.63 of 2014 from the file of learned Principal Senior Civil Judge, Tenali, Guntur District, and transfer the same to any Court either at Chittoor District or Hyderabad.

2. Heard learned counsel for the petitioner.

3. Though, notice is not served on the respondent and returned twice, but the request of the learned counsel for petitioner appears to be unreasonable, as could be seen from the arguments advanced by him.

4. The only ground on which transfer is sought is that the petitioner's father-in-law worked as Superintendent in District Court, Guntur District and, therefore, she suspects that there would be some sort of influence on the Presiding Officer.

5. The father-in-law of the petitioner even if influential, but, certainly, it cannot be presumed or viewed that the Presiding Officer would be carried away by the status of the father-in-law of the petitioner. Therefore, there is no merit in the present transfer petition.

6. Hence, the present transfer petition is dismissed. The learned Principal Senior Civil Judge, Tenali, Guntur District, is directed to dispose of H.M.O.P.No.63 of 2014 as expeditiously as possible, preferably not later than six (6) months from the date of receipt of a copy of this order.

Miscellaneous Petitions, if any, pending in this transfer petition shall stand closed. There shall be no order as to costs. ___________________________ A. SHANKAR NARAYANA, J April 10, 2018.
