HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CRIMINAL PETITION No.10743 of 2018 ORDER:

This criminal petition is filed under Section 438 Cr.P.C. by the petitioner/ A2, seeking release in the event of her arrest in connection with Crime No.186 of 2018 on the file of Nagarkurnool Police Station, Nagarkurnool District, registered for the offences punishable under Sections 304-B, 302 and 307 I.P.C.

Heard learned counsel for the petitioner and learned Public Prosecutor representing the State.

The petitioner/ A2 herein is no other than mother of A1 and mother-in-law of 1st deceased. The offences under Sections 302 and 307 IPC have no application either against the pettioner/ A2 herein or against her son/ A1, who is husband of the 1st deceased.

The sum and substance of the accusation from the de facto complainant, mother of the 1st deceased is that after marriage between the deceased-Madhavi and A1 in February, 2012 and there was continuous harassment to meet the additional dowry by A1 and A2 including unheeding to the elders' advise to treat well and unable to bear with additional demand for dowry and vexed with life, the wife of A1 committed suicide by consuming pesticides poison, which is within seven years of the marriage including by administering

Dr. SSRB,J to the minor daughters aged 6 years and 4 years respectively and while undergoing treatment, the second daughter died while shifting first daughter and the wife of A1 for better treatment in the way to hospital at Hyderabad, near Mahabubnagar, wife of A1-Madhavi died and they admitted the elder daughter in that hospital, where autopsy conducted. Hence to take action.

A perusal of the Case Diary shows that the investigation is in progress and from the allegations about the harassment by petitioner/ A2 also, she is not entitled to the concession of anticipatory bail.

Accordingly, the Criminal Petition is dismissed. 7.

Consequently, miscellaneous petitions, if any shall stand closed.
