HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.3 6 5 5 5 of 2 0 1 8 ORDER: - When the matter is taken up, the written instructions furnished by the Sub-Inspector of Police, Tekulapalli Police Station, Bhadradri Kothagudem District, dated 08.11.2018, are placed on record by the learned Government Pleader. The said instructions read as under: - "The records revealed that as of now, no complaint or case whatsoever was received or registered against the petitioner herein on the file of Tekulapalli Police Station of Bhadradri Kothagudem District, as such, the question of interference of the subject land of the petitioner herein does not arise. It is submitted that the allegation of the petitioner that on several occasions i.e., on 23.05.2017, 14.09.2017, 28.12.2017 and 02.02.2018, 26.03.2018, 09.05.2018, 20.07.2018 and 19.08.
2018 succeeded in resisting the subordinate staff of the 3rd and 4th respondents herein from interfering with the peaceful possession and enjoyment over the subject lands, however, in the recent times, it is learnt by him and believed it to be true that the 3rd and 4th respondents and subordinate staff have been interfering at the instance of the 5th respondent who is a non-tribal and alien to the subject land by yielding to his money and muscle power without having any right or title whatsoever is absolutely false, baseless and invented for the purpose of filing the Writ Petition and hence the same is denied.
It is submitted that as of now, either this respondent or the subordinate staff of 3rd and 4th
respondents visited the subject lands of the petitioner or interfered with it.
It is pertinent to submit that this respondent Police enquiries revealed that as a precautionary measure to prevent the Police from taking any action in the event of lodging of any complaint against him in future, the petitioner as a precautionary measure without any cause of action, filed the present Writ Petition."
Accordingly, the Writ Petition is disposed of, by placing on record the said instructions furnished by the Sub-Inspector of Police, Tekulapalli Police Station, Bhadradri Kothagudem District, dated 08.11.2018, with a further direction to the respondentpolice authorities not to meddle with the civil disputes unless the same is permissible in accordance with law.
Miscellaneous petitions pending, if any, shall stand disposed of. There shall be no order as to costs. ______________ A.V.Sesh a Sai, J Date: 29.11.2018 smr
