O R D E R
This writ petition was filed by a retired employee of Andhra Bank aggrieved by the initiation of disciplinary proceedings against him under notices dated 20.01.2012 and 06.02.2012. His specific complaint was that without supplying relevant documents, the Bank was proceeding against him.
This Court, by order dated 14.02.2012, directed the bank to consider the petitioner's representation dated 09.01.2012. The Enquiry Officer was permitted to proceed with the enquiry, but this Court restrained the bank from passing a final punitive order against the petitioner.
WVMP No.3209 of 2012 was filed by the bank to vacate the above order. However, with the consent of both the learned counsel, the writ petition itself is taken up for disposal. In para 11 of the counter-affidavit, the bank stated that pursuant to the interim order of this Court, the petitioner was once again supplied copies of the relevant documents. His representation dated 09.01.2012 was stated to have been considered and a suitable reply was given to him on 03.03.2012. No reply affidavit was filed by the petitioner rebutting or denying the counter averments.
The bank also stated in its counter that the enquiry against the petitioner had been completed and a copy of the Enquiry Officer's Report dated 30.04.2012 was forwarded to the petitioner calling for his
remarks. The petitioner was stated to have submitted his response under letter dated 26.07.2012, but owing to the order passed by this Court, no final order had been passed in the matter. Perusal of the writ affidavit discloses that the petitioner does not allege violation of any of the applicable service Regulations which govern the bank in so far as disciplinary action against its employees, present and/or past, are concerned. In that view of the matter, as the enquiry against the petitioner has already been completed, this Court sees no purpose served in keeping the present writ petition alive. The writ petition is accordingly closed. The respondent bank shall pass appropriate orders in the subject disciplinary proceedings in accordance with law and it shall be open to the petitioner to avail suitable remedies in law, if aggrieved thereby, by way of independent proceedings before the appropriate forum. Interim order dated 14.02.2012 shall stand vacated. Pending Miscellaneous Petitions, if any, shall stand closed in the light of this final order. No order as to costs.
