HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.25787 of 2016 ORDER:
The petitioner herein is the respondent before the 2nd respondent in P.W Case No.MP.01/2007. The 3rd respondent herein filed a claim petition before the 2nd respondent claiming that some wages were illegally deducted from the wages payable to the workers. Along with the said application, an application for condonation of delay was filed without specifically stating the period which is required to be condoned. In the counter filed by the petitioner herein also, it was not specifically pointed out with regard to the said lapse. However, when an order was passed by the 2nd respondent on 10.04.2016, the present writ petition is filed by the petitioner.
. It is evident that the main case is pending before the 2nd respondent. The present application is only an application seeking condonation of delay. The only ground urged by the learned Counsel for the petitioner is that the 3rd respondent in his application did not specifically state the period which he sought for condonation of delay. That point was not raised by the petitioner herein before the authority and the authority passed the order stating as follows: "On perusal of the material available on record and arguments of both parties, I agree with the contention of the applicant on delay aspect and satisfied by the grounds of delay in the interest of justice and to safe guard the interest of workers who are deprived of the legal wages."
3. Since the present application is only an application seeking condonation of delay in filing the P.W. case, this Court is not inclined to entertain the present writ petition. But, it is open to the petitioner to contest the main case as and when it is numbered by the 2nd respondent herein.
4. The Writ Petition is accordingly dismissed. No order as to costs. Miscellaneous petitions, if any, pending shall stand closed. ______________________________ A.RAMALINGESWARA RAO, J 04-08-2016 Gsn
