Heard learned counsel for petitioner and learned Government Pleader for Revenue (Telangana).
The petitioner claims that she was assigned a land to an extent of Ac.0.32 guntas in Survey No.323 of Nemmikal Village, Atmakur (S) Mandal, Nalgonda District vide proceedings No.2702/2004 of the 4th respondent. The present writ petition is filed alleging that the 4th respondent is trying to dispossess the petitioner from the assigned land based on the proceedings issued by the Revenue Divisional Officer, Suryapet vide proceedings No.2224 of 2007, dated 29.05.2009 cancelling the assigned land. However, in the said order the petitioner's name, as an assignee, is not found and the said order actually does not cover the petitioner's assigned land.
Learned Government Pleader for Revenue on the basis of the 4th respondent's instructions submits that originally the land situated on southern face was proposed for allotment of TSSDPCL for an extent of Ac.0.20 guntas for construction of electrical sub-station deemed it as Government land. Subsequently, the petitioner stated to have been filed objections that her assigned land cannot be allotted and thereby, the petitioner's objection petition was considered in file No.D/2702/2004, dated 28.04.2004. The inspection of the land was accordingly made which shows that Ac.1.21 guntas is vacant land and the petitioner's land in Survey No.323 to the extent of Ac.0.32 guntas was also found. It was further stated that excluding the petitioner's assigned land as above, the balance of the land is proposed for 33/11 K.V.
Sub-Station at Nemmikal Village. It is also stated that the 4th respondent never taken possession of the petitioner's land and the said proposed sub-station at Ac.0.34 guntas is between the land assigned to the petitioner and the land covered by the houses.
From the above, it is clear that the petitioner's assigned land is not affected by the said sub-station and the authorities specifically stated that there is no interference and the sub-station is in fact, besides the petitioner's assigned land.
In view of the above said instructions, no orders are required to pass in this writ petition.
Accordingly, the writ petition is disposed of. There shall be no order as to costs.
Miscellaneous petitions pending in this writ petition, if any, shall stand closed.
