This writ petition was filed assailing the action of the Station House Officer, Mothkur Police Station, Nalgonda District, in issuing the notice dated 03.07.2011 under Section 91 Cr.P.C. The ground of challenge is that the notice was more in the nature of an order.

By order dated 11.07.2011, this Court stayed further proceedings pursuant to the impugned notice.

While so, the learned Assistant Government Pleader for Home produced the notice dated 10.07.2011 issued by the Sub-Inspector of Police, Mothkur Police Station, Nalgonda District, whereby he withdrew the impugned notice dated

03.07.2011 issued under Section 91 Cr.P.C.

In the light of the afore-stated withdrawal, the impugned notice dated 03.07.2011 no longer survives and no further consideration is required in this writ petition.

The writ petition is accordingly dismissed.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
