Heard Mr.Mahaboob Hussain for petitioner.
Third respondent in O.P.No.177 of 2010 in the Court of the Chairman, Motor Vehicle Accident Claims Tribunal-cum-II Additional District Judge, Karimnagar at Jagitial is the revision petitioner. The revision petitioner filed I.A.No.177 of 2010 under Order XVI Rule 1(3) read with Section 151 CPC seeking to issue summons to MVI, RTA Unit Office, Jagitial to give evidence.
The learned trial Judge, by docket order dated 12.11.2013, declined the prayer of petitioner holding that no useful purpose would be served by summoning the witness when no particulars of driving licence are given. Hence, the revision.
I have perused the record. The trial Court has rightly dismissed the application filed by the petitioner. This Court is in agreement with the reasons recorded by the trial Court. No ground warranting interference under Article 227 of the Constitution of India is made out. Revision fails and is, accordingly, dismissed. The trial Court is directed to dispose of O.P.No.177 of 2010 within two months from the date of receipt of a copy of this order. There shall be no order as to costs.
