HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 36668 of 2018 ORDER:
This writ petition is filed seeking to issue a writ of mandamus declaring the action of the 3rd respondent in issuing charge sheet dated 29.09.2018, along with suspension order dated 29.09.2018 simultaneously, keeping the petitioner under suspension, without affording reasonable opportunity of being heard, as illegal and arbitrary. Heard Sri G. Rajesh, learned counsel for the petitioner, and Sri B. Mayur Reddy, learned standing counsel for TSRTC appearing on behalf of the respondents.
Having considered the submissions made by the learned counsel on either side, I am of the view that this Court cannot interfere with the suspension orders, pending enquiry. However, the respondents shall conclude the departmental proceedings initiated against the petitioner and pass appropriate orders, by duly taking into consideration his explanation, as early as possible, preferably, within a period of four (4) months from the date of receipt of a copy of this order.
The writ petition is, accordingly, disposed of. Consequently, miscellaneous applications, if any, pending in the writ petition shall stand closed. No order as to costs.
