HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.21113 OF 2016 ORDER:

This writ petition is filed by the petitioner to declare the action of respondent Nos.2 to 4 in not releasing the compensation for his land to an extent of Ac.1.10 guntas in Sy.No.173 situated at Machinapeta Thanda Village, Julurupadu Mandal, Khammam District, as illegal and arbitrary and consequently, direct the respondents to release the compensation on the basis of the present market value. The case of the petitioner is that the respondents approached him and took possession of the above land in the year 2014 under the proposed Rajiv Dummugudem Lift Irrigation Scheme and the 4th respondent removed 341 teakwood trees without any notice to the petitioner and utilized the entire land for construction of pump house. The respondents paid an amount of Rs.

4,02,059/- to the petitioner as part payment of compensation and promised to pay balance amount of compensation after enquiry, but failed to do so. When the petitioner approached the respondents for payment of the balance compensation amount, they refused to pay the same on the ground that now the department has proposed to construct pump house elsewhere. Since compensation was not paid, the petitioner made representations dated 23.05.2016 and 15.06.2016 to respondent Nos.2 and 3, but the same were not considered so far. Hence, the present writ petition.

Learned counsel for the petitioner submits that the petitioner will be satisfied if direction is given to the respondents to consider the petitioner's above representations expeditiously. Since the petitioner's representations are pending before the respondents, respondent Nos.2 and 3 are directed to dispose of the same expeditiously and preferably within a period of three weeks from the date of receipt of a copy of this order by following due process of law. There shall be no order as to costs.

In view of the disposal of the main writ petition, Miscellaneous Petitions, if any pending in this writ petition shall also stand closed. ______________________________ CHALLA KODANDA RAM,J Date:30.06.2016.
