THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3553 OF 2016 ORDER:

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C) by the petitioners-accused Nos.1 to 6 seeking to quash the proceedings in FIR No.368 of 2015 on the file of Chandanagar Police Station, Cyberabad. Heard and perused the material available on record. The offences alleged against the petitioners are punishable under Sections 498-A IPC. The case of the de facto complainant is that her marriage was performed with the son of the petitioners 1 and 2 in the year 2007 and her husband died in the year 2015. During his lifetime, the petitioners harassed her physically and mentally saying that she is a barren and wanted her husband to marry another girl and after his death also the petitioners harassed the de facto complainant without giving her belongings and necked out her from their house.

The truth or otherwise of the above allegations can be ascertained during investigation of the case. Hence, this Court is not inclined to interfere with the proceedings against the petitioners. At this stage, learned counsel for the petitioners submitted that the petitioners are apprehending arrest and harassment in the hands of police, in view of the pendency of the above crime.

Taking into consideration the submissions of the learned counsel for the petitioners, the police concerned are directed to complete the investigation without arresting the petitionersaccused 1 to 6 and file final report, if any, in accordance with law.

In the event of necessity, the police concerned are directed to issue notice to the petitioners for their appearance before the investigating agency for the purpose of investigation. On issuance of such notice, the petitioners shall appear before the investigating agency and give an undertaking as to their future appearance as and when required by the investigating agency for the purpose of investigation.

With the above directions, the Criminal Petition is disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
