THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.10748 OF 2018 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. for grant of anticipatory bail to the petitioners-A.1 to A.3 in Crime No.720 of 2018 of Mailardevpally Police Station, Ranga Reddy District, registered for the offences punishable under Sections 307 and 120B I.P.C. This is the second bail application. Earlier bail application filed by the petitioners-A.1 to A.3 in Crl.P. No.10069 of 2018 was dismissed as withdrawn vide order dated 27.09.2018.

Heard the learned counsel for the petitioners-A.1 to A.3 and the learned Additional Public Prosecutor appearing for the respondentState, apart from perusing the material available on record. 3.

Learned counsel for the petitioners-A.1 to A.3 would contend that the petitioners-A.1 to A.3 are innocent persons and they are falsely implicated in this case due to the civil disputes between them and the de facto complainant; there are no specific and grave allegations against the petitioners-A.1 to A.3; and ultimately, prayed to allow the bail application. 4.

Learned Additional Public Prosecutor opposed the grant of bail to the petitioners-A.1 to A.3 under Section 438 Cr.P.C. 5.

The material placed on record reveals that the allegations leveled against the petitioners-A.1 to A.3 are grave in nature. There are direct witnesses and specific overt acts against the petitioners. The investigation is in progress. Therefore, it is not a fit case to grant bail to the petitioners-A.1 to A.3 under Section 438 Cr.P.C. The criminal petition is devoid of merit and it is liable to be dismissed.
