WRIT PETITION No.2855 of 2016 ORDER :

The disciplinary proceedings initiated against the petitioner resulted in imposing the punishment of stoppage of one annual grade increment without cumulative effect by the Managing Director (2nd respondent), vide his proceedings dated 15.06.2015. Aggrieved by the said order petitioner preferred appeal to the Chairman, Andhra Pradesh State Housing Corporation Ltd., (1st respondent) on 26.08.2015. Alleging that the appeal is yet to be disposed of and illegally punishment is imposed and the same is being operated, this writ petition is filed.

2. Petitioner has right of appeal before the appellate authority. Against the decision of the 2nd respondent, petitioner has already availed the said remedy and the same is pending. Since appeal is pending, this Court is not inclined to go into the validity of contentions and to consider the issue on merits at this stage. It would suffice if the writ petition is disposed of directing the 1st respondent to pass orders on the appeal filed by the petitioner on 26.08.2015, as expeditiously as possible, preferably within a period of eight (8) weeks, from the date of receipt of copy of this order. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
