The complaint of petitioner is limited to the extent of inaction of third respondent in adjudicating the claim petition filed by petitioner on 28.09.2016 in EP.No.20 of 2014 under Rule 52 (21) (a) and (b) of Telangana State Cooperative Societies Rules, 1964 as amounting to refusing to exercise jurisdiction conferred on the third respondent. 2.

Counsel for petitioner has invited the attention of the Court to the claim petition dated 28.09.2016.

I have perused the claim petition and prima facie, the Court is satisfied that without deciding the claim petition, filed by petitioner, the proceeding to take next step in the matter leads to irreparable injury and hardship to petitioner. Hence, the writ petition is disposed of by this order:

The third respondent is directed to pass order on the claim petition within six (6) weeks from the date of receipt of copy of this order. Till a decision is taken and communicated to petitioner, the third respondent shall not proceed with EP.No.20 of 2014. To avoid delay to the decree holder, the third respondent ensures timely compliance in disposing of the claim petition. As a sequel, the miscellaneous applications pending, if any, shall stand closed. There shall be no order as to costs.
