ORDER

The petitioner, who is A.1 in C.C.No.579 of 2013 on the file of III Additional Metropolitan Sessions Judge, Hyderabad, filed the present application under Section 438 Cr.P.C. seeking release in the event of her arrest in connection with above case. A charge sheet came to be filed for an offence punishable under Section 420 of Indian Penal Code. Heard learned counsel for the petitioner as well as the learned Public Prosecutor appearing for the respondent-State. Material on record goes to show that two other cases were also registered against the petitioner wherein she was granted regular bail. However, insofar as this crime is concerned, charge sheet is filed showing the petitioner as absconding. As such, non-bailable warrant was issued against the petitioner.

Since the petitioner was granted regular bail earlier and in the facts and circumstances of the case, the petitioner, if so advised, shall appear before the trial Court and move an application for grant of bail after giving prior notice to the Public Prosecutor, in which event the same shall be dealt with by taking into consideration the circumstances referred to above and shall consider the request of the petitioner on the same day, in accordance with law.
