HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.13212 of 2015 ORDER:
Heard the learned counsel for the petitioner and the learned Standing Counsel for the respondents. The Writ Petition is being disposed of at the stage of admission with the consent of parties.
As per the averments in the Writ Petition, the petitioner and his family members are owners of house bearing Nos.1-3-172 to 1-3-185 situated at Kazipet, Warangal. In respect of the property owned by the petitioner, there was urban land ceiling proceedings. However, it appears that some people occupied the land belonging to the petitioner. It is their allegation that, at the instance of encroachers, the respondents gave electricity connection also. In those circumstances, the petitioner submitted representations dated 14.04.2015 and 18.04.2015 to the respondents not to give electricity connection to the encroachers without satisfying themselves about the title to the land. As the said representations were not disposed of, the present Writ Petition is filed. Learned standing counsel for the respondents submits that no unauthorized electrical connection was given to any person so far in respect of the property claimed by the petitioner.
However, in view of pendency of the representations of the petitioner dated 14.04.2015 and 18.04.2015, the Writ Petition is disposed of directing respondent Nos. 4 and 5 to consider the representation to be submitted by the petitioner. The petitioner is at liberty to file a fresh representation to respondent Nos. 4 and 5 within a period of fifteen days from the date of receipt of a copy of the order, on receipt of which, respondent Nos. 4 and 5 shall consider the same, and pass appropriate orders in accordance with law. The Writ Petition is, accordingly, disposed of. Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of. No order as to costs.
