HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.937 OF 2016 ORDER:

This petition is filed by the petitioner - Accused No.2 under Sections 437 & 439 of Criminal Procedure Code seeking to grant bail in Crime No.307 of 2015 on the file of Bahadurpura Police Station, Hyderabad City, registered for the offence punishable under Section 302 IPC.

Heard and perused the material available on record. The petitioner and A1 are friends. The allegation against the petitioner is that aggrieved over the implication of A1 in a crime by the deceased, the petitioner and A1 committed murder of the deceased by causing bleeding injuries with draggers.

Learned counsel for the petitioner submitted that the allegations made against the petitioner are false and the petitioner was implicated in the case basing on the confession of A1 and the petitioner is a student of Intermediate second year and he was arrested on 03.12.2015 and since then he has been in judicial custody. Learned Public Prosecutor submitted that the investigation is at early stage and the manner in which the deceased was subjected to death is cruel in nature, and hence, he sought for dismissal of the criminal petition.

In view of the submissions of the learned Public Prosecutor, this Court is not inclined to grant bail to the petitioner. Accordingly, the Criminal Petition is dismissed. ______________ RAJA ELANGO, J February 08, 2016.
