THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.7378 of 2016 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Civil Supplies for respondents and with their consent the writ petition is disposed of at the admission stage. The case of the petitioner is that he was appointed as Fair Price Shop Dealer of Shop No.4, Kalluru Village, Pulicherla Mandal, Chittoor District, in the year 2000 on permanent basis and his authorization has been renewed from time to time. While so, respondent No.4-Tahasildar, Pulicherla Mandal visited the shop of the petitioner on 21.01.2016 and found that the petitioner has not distributed Chandranna Sankranthi Kanukalu properly to the cardholders and his Fair Price Shop was being run by his brother's son and submitted a report. Basing on that 3rd respondent-Revenue Divisional Officer, Tirupathi has suspended the authorization of the petitioner pending enquiry. Challenging the same, the present writ petition is filed.

A perusal of the suspension order dated 06.02.2016 reveals that except making a bald allegation that there is a contravention to the A.P.P.D.S. Control Order 2008 and petitioner has not distributed the Chandranna Sankranthi Kanukalu properly to the cardholders, there are no other details in the suspension order. Further, the suspension order also does not reveal show cause notice having been issued to the petitioner. As the suspension order is bereft of any basic details, the same cannot be sustained. Accordingly, the same is liable to be set aside.

Accordingly, the writ petition is allowed. However, this order does not preclude the authorities to take action against the petitioner if there are any violations in accordance with the settled principles. As a

sequel, pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
