SMT JUSTICE T. RAJANI CRIMINAL PETITION No.10905 of 2011 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash the proceedings against the petitioners/A.1 to A.3 in Crime No.157 of 2011 of Tiruvuru Police Station, Krishna District, registered for the offences punishable under Sections 406 and 420 IPC.

The allegations in the complaint would go to show that the petitioners have prepared the list of beneficiaries in manuscript and subsequently certain omissions and commissions have taken place and thereafter, the modified list was computerized. From the enquiry report, which was filed by the Executive Director, it was found that while the petitioners are enumerating the work and preparing Manuscript lists by visiting the fields, they entered some entries without survey number, some entries with wrong survey number, some entries with wrong tenant farmers, some entries with less extent recorded as more extent, some survey numbers entered both in paddy and cotton and duplicate names etc. 3.

Hence, in the background of the said allegations, the contention that the amounts have been disbursed to the beneficiaries does not find any merit, as the beneficiaries themselves may not in accordance with the list enumerated by the petitioners. The truth would come to light only after trial of the case. Hence, it is not a fit case for quashing the proceedings, at this stage.

Accordingly, the Criminal Petition dismissed. However, considering the request of the petitioners, the respondent-police are directed to effect the arrest of the petitioners in accordance with the procedure established under Section 41-A Cr.P.C. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
