Heard learned counsel for the petitioner and Additional Public Prosecutor appearing for the respondent-State. In spite of service of notice there is no representation on behalf of the second respondent.
The present Criminal Revision Case is filed assailing the order dated 24.06.2015 passed in Crl.M.P.No.2597 of 2014 in C.C.No.334 of 2013 on the file of the II Additional Judicial Magistrate of First Class, Nellore, wherein and whereunder an application under Section 239 Cr.P.C. seeking discharge was rejected.
Though various grounds are raised in the revision, learned counsel for the petitioner restricts his prayer seeking dispensation of the presence of the petitioner in C.C.No.334 of 2013 on the ground that she is lady and aged about 85 years and it would be difficult for her to attend the Court on every date of adjournment. The learned Additional Public Prosecutor submits that since the identity of petitioner is not in dispute, her presence in the above C.C. may not be necessary on every date of adjournment. Having regard to the nature of allegations made and taking into consideration that the petitioner is lady and aged about 85 years, her presence in C.C.No.334 of 2013 on the file of the II Additional Judicial Magistrate of First Class, Nellore, is hereby dispensed with except on the dates when her presence is specifically required by the Court and the trial Court shall
dispose of the C.C. as expeditiously as possible. With the above direction, the Criminal Revision Case is disposed of.
