M. Venkata Ramana v. The State Of Telangana
HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P.No.36725 of 2018
ORDER
When the matter is taken up for hearing, learned counsel on either side fairly concede that the issue involved in this writ petition is squarely covered by the judgments of the Apex Court in District Collector/Chairman and Others Vs. M.L.Singh and Others1 and B.Srinivasulu vs. Nellore Municipal Corporation in Civil Appeal No.6318 of 2015 (arising out of SLP(C) No.12432/2014) dt.17.08.2015 and contended that the present writ petition be disposed of in terms of the above said judgments.
In view of the above submissions and for the reasons alike in the aforesaid judgments of the Apex Court, this writ petition is disposed of directing the respondents to regularize the services of the petitioners on the basis of Notification issued in G.O.Ms.No.212 dated 22.04.1994 with effect from the date the petitioners completed five years' continuous service. It is however made clear that the other conditions laid down in the said G.O.Ms.No.212 will have to be satisfied for the purpose of regularization. No costs.
Pending miscellaneous petitions, if any, shall stand closed. _____________________________________ JUSTICE ABHINAND KUMAR SHAVILI Date: 20.12.2019 rkk 1 (2009) 8 Supreme Court Cases 480
