THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 19287 OF 2016 O R D E R:

The order dated 03.08.2015 passed by the 3rd respondent Revenue Divisional Officer, Chevella Division, whereby the authorization of the petitioner fair price shop dealer of Shop No.22, Murtuzaguda Village, Moinabad Mandal, Ranga Reddy District was cancelled, is under challenge in this Writ Petition. Learned counsel for the petitioner fairly submits that as against the order dated 03.08.2015, the petitioner has already preferred an Appeal before the 2nd respondent Joint Collector on 29.12.2015 along with Stay Application.

Learned Government Pleader for Civil Supplies (Telangana) would submit that inasmuch as the Appeal has already been filed by the petitioner, the Appellate Authority may be directed to dispose of the Appeal.

In the circumstances, having considered the submissions made on either side and also having regard to the nature of the allegation made against the petitioner that instead of distributing the commodities at the authorized premises bearing D.No. 1-81, he is distributing the commodities from his uncle's house at D.No. 1-23/7, the 2nd respondent Joint Collector is directed to consider and dispose of the Appeal within four weeks from today. If the 2nd respondent fails to decide the Appeal within the above-set time-frame, the petitioner's authorization to run the fair price shop shall be restored till the disposal of the Appeal.

With this, the Writ Petition stands disposed of. No costs. Consequently, the miscellaneous Applications, if any shall also stand disposed of.
