THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37299 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking to declare the action of the 3rd respondent in not providing police protection to the petitioner and to his landed property in Survey No.270/2, to an extent of Ac. 0.69 cents, situated in Gundrajukuppam Village Accounts, Nagari Mandal, Chittoor District, as illegal and arbitrary and consequently direct respondents 2 & 3 to provide forthwith police protection to the petitioner in respect of the said property and also direct the 4th respondent not to interfere with the petitioner's peaceful possession and enjoyment of the said property in terms of the permanent injunction decree, dated 24.06.2014, in O.S.No.17 of 2000, on the file of the Junior Civil Judge, Nagari, Chittoor District.

The case of the petitioner is that the petitioner gave complaint to the 3rd respondent on 21.10.2016 reporting the interference of the 4th respondent in respect of the subject property and requested for police aid for him and for the subject property for effective implementation of the permanent injunction decree, dated 24.06.2016.

Learned Assistant Government Pleader for Home informed that a complaint was received by the 3rd respondent by Registered Post on 21.10.2016 regarding the incident, dated 20.10.2016 and on the basis of the said complaint, already a crime is registered as Crime No.209 of 2016, dated 07.11.2016, for the offences under Sections 447 & 506 IPC against the 4th respondent and others and

investigation is in progress. Learned Assistant Government Pleader also informed that if there is any law and order problem, the 3rd respondent will take necessary action. Recording the said submissions, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed.
