HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 38144 of 2012 ORDER:
Heard learned counsel for the petitioner and learned Government Pleader for Revenue. With the consent of both the parties, the Writ Petition is disposed of at the admission stage itself. The present Writ Petition came to be filed seeking to issue writ of mandamus declaring the action of respondents in not considering the application dated 06.03.2012 made by the petitioner and others for assignment of land in Survey No.1484 admeasuring Acs.3.75 cents situated at Buttaigudem Village and Mandal, West Godavari District, as illegal and arbitrary. Though various grounds are raised in the Writ Petition, learned counsel for the petitioner restricts his prayer seeking a direction to the Tahsildar (3rd respondent) to consider the application made by the petitioner dated 06.03.2012 seeking assignment of land at the earliest. Learned Government Pleader submits that the request of the petitioner can be considered provided the said representation is still pending consideration.
Without going into merits of the case, the Writ Petition is disposed of directing the third respondent to consider the application dated 06.03.2012 made by the petitioner seeking assignment of land in Survey No.1484 admeasuring Acs.3.75 cents situated at Buttaigudem Village and Mandal, West Godavari District, in accordance with law, within six (06) weeks from the date of receipt of a copy of this order, if the said representation is still pending. No costs.
