This petition is filed under Section 24 of the Code of Civil Procedure, 1908, to withdraw F.C.O.P.No.22 of 2014 on the file of the Family Court, Secunderabad and transfer the same to the Family Court, Guntur.
Heard both the learned counsel and perused the affidavit filed in support of the petition and the counter filed by the respondent. A perusal of the record shows that the marriage of the petitioner was performed with the respondent on 07.06.1995 at Nellore as per Hindu rites and customs. Immediately after the marriage, the petitioner joined the respondent. Out of the wedlock, they were blessed with two daughters on 14.10.1998 and 04.10.2001 respectively. Initially, the respondent filed O.P.No.361 of 2010 on the file of the Family Court, Secunderabad, for dissolution of marriage between him and the petitioner. When the matter came up for arguments, the respondent has withdrawn O.P.No.361 of 2010 with a liberty to file fresh petition.
Learned counsel for the petitioner submitted that the petitioner lodged a complaint to the police against the respondent for the offences punishable under Section 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act. The petitioner filed F.C.O.P.No.333 of 2014 on the file of the Family Court, Guntur seeking maintenance from the respondent. The respondent filed F.C.O.P.No.22 of 2014 on the file of the Family Court, Secunderabad seeking dissolution of marriage between him and the petitioner.
The petitioner has been working as UDC in Passport Office at Vijayawada and the respondent has been working as Government Doctor at Sangareddy.
Learned counsel for the respondent submitted that if at all this Court intends to transfer the matter, the same may be transferred to Vijayawada, as there is life threat to the respondent if he goes to Guntur.
The fact remains that the petitioner has been working at Vijayawada.
Both the learned counsel agreed for transfer of F.C.O.P.No.22 of 2014 from Secunderabad to Vijayawada.
Having regard to the submission made by both the counsel, the Transfer C.M.P. is disposed of and F.C.O.P.No.22 of 2014 is withdrawn from the file of the Family Court, Secunderabad, and transferred to the Family Court, Vijayawada, for disposal in accordance with law. Consequently, miscellaneous petitions, if any, pending shall stand closed.
