THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.5502 OF 2016 ORDER:

This petition is filed by the petitioner challenging the order dated 26.10.2015 passed in Crl.M.P.No.1619 of in Crl.M.P.No.3491 of 2010 in M.C.No.24 of 1992. Heard and perused the material available on record. The petitioner filed the above Crl.M.P.No.1619 of 2015 against her husband-1st respondent seeking arrears of maintenance. When the said Crl.M.P. was posted to 26.10.2015, the petitioner did not attend before the Court below. Hence, the Court below dismissed the above Crl.M.P. Aggrieved by the same, the petitioner filed this petition. Considering the facts and circumstances of the case, this Court is inclined to pass the following order:

"The order impugned is set aside. Consequently, the above Crl.M.P.No.1619 of 2015 is restored. The trial Court is directed to dispose of the said Crl.M.P., in accordance with law, after hearing both the parties."
