HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35688 of 2016 ORDER:
This writ petition is filed by the petitioner seeking to declare the action of the 3rd respondent in forceful dispossession and seizing the petitioner's residential house situated at Door No.29-30 in Survey No.603 of Sanjay Nagar, Sudimalla Panchayat, Illendu Mandal, Bhyadradri Kothagudem District as illegal and arbitrary. Heard and perused the material available on record. The main grievance of the petitioner is that the 4th respondent is interfering with the property of the petitioner. The petitioner enquired with the interest and claim of the 4th respondent and revealed that her property is situated at D.No.2120/1, said to have been purchased from different person and the 4th respondent approached the 3rd respondent for aid in order to grab the property of the petitioner. Respondents 3 and 4 visited the house of the petitioner and forcefully dispossessed him from the house and locked the premises.
Learned counsel for the petitioner submitted that the subject property is situated at Agency Area and the Regulations under Act 1 of 1970 is applicable to the subject property and the 4th respondent is non-tribe and the petitioner is tribe. Considering the facts and circumstances of the case and the submissions of the learned counsel for the petitioner, the 3rd respondent is directed not to interfere with the affairs of the petitioner and the 4th respondent, more particularly, with the civil disputes pending between them. However, this Order will not
stand in the way of the 3rd respondent to register a case, if any complaint is lodged against the petitioner for cognizable offence. Accordingly, the writ petition is disposed of. No costs.
