The grievance of the petitioners in this case was that the Station House Officer, Atchutapuram Police Station, Visakhapatnam District, is interfering with their possession over their agricultural land in Sy.No.161 of Dopperla Village and Post, Atchutapuram Mandal, Visakhapatnam District.
The Station House Officer, Atchutapuram Police Station, Visakhapatnam District, filed counter-affidavit dated 09.08.2011 denying the allegation of the petitioners that he ever interfered with their possession over the subject land. He further stated that the dispute between the petitioners and the unofficial respondents was predominantly civil in nature and that the police authorities had nothing to do with the same. He asserted that he never summoned the petitioners to the police station or detained them there for hours together.
As this counter-affidavit was filed long ago, the learned Assistant Government Pleader for Home was asked to get instructions as to the present status. Thereupon, the Station House Officer, Atchutapuram Police Station, Visakhapatnam District, furnished written instructions dated 16.06.2015 to the office of the learned Government Pleader for Home, wherein he stated that no complaint had been received against the petitioners even as on date and therefore, the question of summoning them to the police station did not arise. He reiterated that the dispute between the petitioners and the unofficial respondents was a civil dispute and that the police authorities had nothing to do with the same.
Recording the afore-stated stand of the police authorities, the writ petition is dismissed.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
