THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.36788 of 2018 ORDER:
When the matter is taken up, written instructions dated 10.10.2018 furnished by the Station House Officer, Konakanamitla PS, Prakasam District are placed on record by the learned Government Pleader for Home.
To the extent of their relevance to the present writ petition, the said instructions read as under:
"It is submitted that the writ petition herein filed the present writ petition by raising certain allegations against the respondents 2 to 4 herein that they did not register the crime against her daughter-in-law Ravula Savithri and others, as they committed theft of 27 sheep worth about Rs.3.00 lakhs. Apart from that the 4th respondent herein has been threatening her for withdrawing the said complaint, all the allegations are incorrect, baseless and are concocted.
It is respectfully submitted that the writ petition herein sent a report to the 2nd respondent herein, through Registered Post. After receipt of the same, the 2nd respondent herein forwarded the same to the 4th respondent herein, for taking necessary action. After receipt of the same, the 4th respondent herein entered the same in the General Diary on 29.09.2018 and he enquired into the matter in the vicinity of the writ petitioner herein. He further examined four persons and recorded their statements. The statements are herewith enclosed for kind perusal.
It is submitted that basing ont he statement of the examined persons, the 4th respondent herein came to know that the writ petitioner herein and the said Savithri are mother-in-law and daughter-in-law and have been residing under the same roof. The said Savithri had a daughter, attained age of marriage. Son of the petitioner, who is none other than husband of said Savithri went away along with another lady, by deserting his wife and daughter. But the writ petitioner herein has been supporting her son financially. Apart from that, she tried to sell away the said sheep for helping her son. Due to the same, some
differences had been prevailed between the petitioner and her daughter-in-law. In connection with the same, her daughter-inlaw took away their sheep and keeping them in her safe custody, with a view to utilize them for the expenditure of her daughter. Basing on the same, on 02.10.2018, the 4th respondent herein submitted his reply to the 2nd respondent herein stating that it is a family dispute and has to be resolved before the appropriate forums. Moreover, the 4th respondent herein intimated the same through registered post on 11.10.2018. Copy of the letter is herewith enclosed for kind perusal. It is submitted that the respondent police never committed any illegality or irregularity in not registering the crime.
After receipt of complaint from the 2nd respondent, I conducted enquiry in the matter and submitted proper reply to the 2nd respondent herein and also intimated the same to the writ petition herein. I have great respect on the courts and its orders. I will obey the orders if any passed by this Hon'ble Court in connection with the present writ petition." On noticing the above instructions, a request is made by the learned counsel for the petitioner to place the said instructions on record and dispose of the writ petition.
Accordingly, the writ petition is disposed of by placing on record the written instructions dated 10.10.2018 furnished by the Station House Officer, Konakanamitla PS, Prakasam District, leaving it open to the petitioner herein to avail alternative remedies available under law. There shall be no order as to costs. Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed.
