HON'BLE SRI JUSTICE RAJA ELANGO Criminal Revision Case No.1824 of 2016 ORDER:

This revision is preferred challenging the order dated 04.04.2016 in C.F. No.2582 of 2015 passed by the II Additional Judicial Magistrate of First Class, Nellore, wherein the learned Magistrate directed the office to number the case after production of original caste certificates of the complainant and the accused.

2. After arguing some time, learned counsel for the petitioner confined his argument only with regard to recall of NBW issued against the petitioner.

3. Having heard the learned counsel for the petitioner and the learned Additional Public Prosecutor and having perused the material available on record, this Court is of the view that the revision can be disposed of with the following direction:

The petitioner/accused is directed to appear before the Court concerned and file a petition to recall the warrant issued against him and on filing of such a petition, the trial Court is directed to recall the warrant on the same day on his execution of bond for a sum of Rs.5,000/- (Rupees five thousand only) with one surety for a like sum and further the petitioner is directed to appear before the trial Court regularly.

5. Accordingly, the Criminal Revision Case is disposed of. Consequently, the Miscellaneous Petitions pending, if any, in this revision shall stand closed.
