ORDER
This criminal petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, by the petitioner/A.2 seeking anticipatory bail in connection with Crime No.127 of 2025 of Mugpal Police Station, Nizamabad District. The offences alleged against the petitioner are under Sections 318(4) of Bharatiya Nyaya Sanhita, 2023 and under Section 5 of the Telangana Protection of Depositors and Financial Establishment Act, 1999.

The facts of the case are that the complainant lodged a complaint stating that she is a domestic maid at a woman's house in Aryanagar. One day, the accused No.1 told her that about 3 acres of land was available for sale at Armoor and Ankapoor for Rs.2,67,000/- and asked her if she is interested in buying it. The complainant informed A.1 that she could not afford to buy the land, as such A.1 suggested that she could pay the amount in parts whenever she had money, and she would handle the rest. Tempted by her offer, the complainant informed her husband and both of them approached A.1 and paid her Rs.50,000/-. After four months, they again gave her Rs.30,000/-, and later another Rs.70,000/-. When they asked her to show the land, she said bore well digging and leveling work was in progress and promised to take them later.
It is further alleged that after some time, A.1 took another Rs.1,17,000/- from them and when they insisted to see the land, she claimed that she had sold it and the sale proceeds would be credited to their bank account and advised them to open an account at Union Bank and took photocopies of her passbook and PAN card. A.1 also lured them that they would receive a good amount from the land sale and asked for a commission.
- 3 - book, she gave a cheque of her husband's HDFC Bank account. Thereafter, A.1 said she could arrange 3 acres of land for others and asked the complainant to refer others. Believing her, complainant introduced her co-sister, Mekala Yamuna. A.1 made similar promises to Yamuna, who then paid her Rs.8,33,000/- in cash and also took a blank signed cheque and promissory notes from her. But A.1 neither returned their money nor gave them any land. When they questioned her, A.1 threatened them to file cheque bounce cases which she had collected from them. Thereafter the complainant came to know that A.1 had cheated many others in the same way. On 17.03.2025, A.1 was confronted in the presence of elders where she admitted to receiving the money, issued receipts for half the amount, and promised to repay half by 20.07.2025. However, after that date, when they reminded her, she refused to return the money. Hence, requested the police to take necessary action against the accused. Basing on the said complaint, the police registered the case against the accused for the said offences. 3.
Heard Sri G.Satyanarayan Reddy, learned counsel appearing for the petitioner and Sri E. Ganesh, learned Assistant Public Prosecutor appearing for the respondent-State.

The contention of learned counsel for the petitioner is that there are no allegations against the petitioner herein except that he is the husband of A.1. A.1 was already arrested and she is in judicial custody. Petitioner herein is falsely implicated in this case and he is ready to cooperate with the investigating officer. Hence, prayed this Court to grant anticipatory bail to the petitioner herein.

On the other hand, learned Assistant Public Prosecutor opposed bail stating that there are specific allegations against this petitioner also. The entire amount was transferred to the account of the petitioner herein. Hence, petitioner is not entitled for bail and prayed to dismiss this petition. 6.
Considering the submissions made and perusal of material on record, the petitioner herein is arrayed as A.2 and all the allegations are against A.1 as she collected amounts from the victims under the guise of selling of land and promised to repay the same. A.1 was already arrested. Considering the allegations against the petitioner herein and the facts of the case, this Court deems it fit to grant bail to the petitioner subject to the following conditions :

The petitioner/A.2 shall surrender before the Station House Officer, Mugpal Police Station, Nizamabad District within two weeks from today, and on such surrender, the said Station House Officer shall release petitioner/A.2 on bail on his executing a personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, for the like sum each.

The petitioner/A.2 shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight (8) weeks, for the purpose of investigation or till filing of charge sheet whichever is earlier and thereafter, as and when required.
iii.
The petitioner/A.2 shall abide by the other conditions stipulated in Section 482 (2) of BNSS and co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed.
