2015-06-26Sanjay Kumar1 pages

THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.24393 of 2011 ORDER:

The grievance of the petitioners herein was that the Station House Officer, Yellanur Police Station, Anantapur District, was compelling them to sign on white papers and admit to an offence. The Sub-Inspector of Police, Yellanur Police Station, Anantapur District, filed a counter-affidavit stating that the Forest Section Officer, Singavaram Beat, lodged a complaint with the Station House Officer, Yellanur Police Station, Anantapur District, as to the commission of an offence whereupon Crime No.83 of 2010 was registered under Section 379 I.P.C., against the petitioners and another. The details of the investigation were set out by the Sub-Inspector, which significantly do not show that any confession was made by the accused in the crime. The Sub-Inspector categorically denied the allegation of the petitioners that they were made to sign on white papers so as to admit to any offence.

In the light of the facts brought up by the police authorities through the aforestated counter, the allegation of the petitioners is shown to be without basis.

The writ petition is accordingly dismissed.

Pending Miscellaneous Petitions shall also stand dismissed. No order as to costs.
