Ijja Govinda Rao v. The Superintending Engineer,
THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.15168 OF 2002 ORDER:
1.
This writ petition is filed seeking to issue a writ of mandamus declaring the order of the 1st respondent dated 8.10.2001, which was modified through the order of the 2nd respondent dated 16.7.2002, as illegal and arbitrary and to set aside the same. 2.
Heard Sri S. Ashok Anand Kumar, learned Counsel for the petitioner and Sri M. Ravindra, learned Standing Counsel for the respondents. 3.
It has been submitted by the learned Counsel for the petitioner that the petitioner was imposed punishment of stoppage of two increments with cumulative effect by order dated 8.10.2001 and challenging the same, the petitioner preferred an appeal before the appellate authority and that the appellate authority modified the said punishment to that of stoppage of one increment without cumulative effect and aggrieved by the said punishment, the petitioner filed this writ petition. 4.
Learned Standing Counsel for the respondents submits that the punishment of stoppage of one increment without cumulative effect had already been worked out and at the end of currency of punishment, the petitioner was given all the benefits and moreover, the petitioner has expired during the pendency of this writ petition and therefore, nothing survives for adjudication in this writ petition. 5.
Considered the submissions made by the parties. The punishment of stoppage of one increment without cumulative effect had already been worked out on its own and after one year of currency of that punishment,
the petitioner would have got all the benefits. The learned Counsel for the petitioner agreed and submitted that after one year of currency of the said punishment, the petitioner was released the increments to which he is entitled.
6.
Recording the above submissions, the Writ Petition is dismissed as infructuous. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
