HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.6404 of 2015 ORDER:
This petition is filed by the petitioner-accused No.3 under Section 438 Cr.P.C. seeking anticipatory bail in PRC No.61 of 2014 on the file of the Judicial Magistrate of First Class, Parigi, Ranga Reddy District, for the offences punishable under Sections 323 IPC and 3 (1) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities Act, 1989.
Heard and perused the material available on record. The allegations against the petitioner are that she along with other accused abused the de facto complaint in the name of her caste and also beat the de facto complainant and her son with hands. Learned counsel for the petitioner submitted that the petitioner is innocent of the offences alleged against her and she was falsely implicated in the case. He further contended that after completion of investigation, the police filed charge sheet before the Court below by showing the petitioner as absconding and hence, the Court below has issued NBW against the petitioner, and the other accused were arrested and released on bail.
Considering the circumstances, this Court is not inclined to grant anticipatory bail to the petitioner.
However, taking into consideration the submissions made by the learned counsel for the petitioner, this Court is inclined to pass the following order: The petitioner - accused No.4 is directed to surrender before the Judicial Magistrate of First Class, Pargi, Ranga Reddy District, and file an application to recall the NBW issued against her. On filing of such application, the learned Magistrate is directed to recall the warrant issued against the petitioner on her executing a personal bond
of a sum of Rs.20,000/- (Rupees twenty thousand only) with one surety for the like sum for her future appearance before the committal Court as well as the trial Court.
