HONOURABLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.37050 OF 2018 ORDER:

The petitioner filed this Writ Petition challenging the suspension order dated 29.9.2018.

One of the contentions raised by the learned Counsel for the petitioner is that the allegations leveled against the petitioner is that she committed certain irregularities while she was working as Headmistress/Mandal Educational Officer, Uppanunthala, and that the petitioner was shifted from that place way back in the year 2015, and for the irregularities alleged to have been committed by the petitioner at Uppanunthala, she cannot be placed under suspension in the place where she is presently working. He further contended that there are no allegations against the petitioner in the place where she is presently working.

This Court is not inclined to interfere with impugned order dated 29.9.2018. However, this Court is of the view that this writ petition can be disposed of directing the petitioner to submit a representation if she is aggrieved by the suspension order dated 29.9.2018.

Accordingly, the Writ Petition is disposed of directing the petitioner to submit a representation to the respondents, if she

is aggrieved by the suspension order dated 29.9.2018. On such representation being received, the respondents will consider and pass appropriate orders thereon, within a period of four weeks from the date of receipt of a copy of this order, in accordance with law. The petitioner is at liberty to raise all the legal grounds in the said representation. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
