THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.13219 of 2016 ORDER:

The petitioner, who is A.14 in crime No.5 of 2016 of Noothankal Police Station, Nalgonda District, filed the present application under Section 438 of the Code of the Criminal Procedure (Cr.P.C.), seeking release in the event of his arrest in connection with the above crime registered for the offences punishable under Sections 420, 468 and 471 of Indian Penal Code.

Heard learned counsel for the petitioner as well as the learned Additional Public Prosecutor.

When the matter is taken up for hearing, it is brought to the notice of this Court that A.3 was granted anticipatory bail by the II Additional Sessions Judge, Nalgonda at Suryapet, vide orders dated 24.08.2016 passed in Crl.M.P.No.912 of 2016. It is further submitted that A.1, A.4 to A.10 were also granted bail. Since the petitioner also stands on the same footing as that of A.3, the request of the petitioner can be considered.

Therefore, the Criminal Petition is disposed of directing the petitioner to surrender before the Court below and move an appropriate application seeking bail after giving prior notice to the Public Prosecutor, in which event, the same shall be considered on the same day, in accordance with law, on such terms and conditions as the said Court deems fit.
