HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 36759 of 2018 ORDER:
1) Heard learned counsel for the petitioner, learned Government Pleader for Municipality and Sri Nimmagadda Venkateswarlu, learned Standing Counsel for respondent No.4.
2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondents in not incorporating Survey No.15 - 2 part of Amadalavalasapeta village in Pre DCR of scrutiny and sanction of building plans, as illegal and arbitrary. 3) At the time when the matter is taken up for hearing, learned Standing Counsel would submit that request of the petitioner could not be considered since the DCR does not indicate the survey number. It is his plea that the entire process of issuing permission would be done online by the Nodal Agency, for which survey number is essential. He submits that if an application is made to respondent No.4 for inclusion of the survey Number in the DCR (rectification of traffic system), the same would be considered immediately. 4) Having regard to the above, the writ petition is disposed of permitting the petitioner to make an application before respondent No.4 or any other officer In-Charge, in which
event the authority concerned shall consider the same for incorporating the survey number in the said DCR. It is needless to mention that on the application made, the authorities shall consider the same, as early as possible, preferably within a period of a week thereafter. 5) Miscellaneous petitions, pending if any, shall stand closed in the light of this final order.
