THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.22072 of 2012 ORDER:

Crime No.173 of 2011 was registered on the file of Kodada Rural Police Station, Nalgonda District, under Sections 498-A and 306 I.P.C., in relation to the death of the petitioner's sister. Aggrieved by the investigation by the police authorities in the said crime, he filed this writ petition seeking transfer of the case to the CID. Relying on the written instructions dated 07.07.2015 furnished by the Sub-Inspector of Police, Kodada Rural Police Station, Nalgonda District, the learned Assistant Government Pleader for Home informed this Court that upon investigation in Crime No.173 of 2011 on the file of Kodada Rural Police Station, Nalgonda District, it was found that the petitioner's sister had committed suicide. The Civil Assistant Surgeon who held autopsy over the corpse opined that the cause of death was due to hanging.

As a prima facie case was established against the two accused, they were charge sheeted in Sessions Case No.353 of 2013 and the case was stated to be pending at the trial stage before the competent Court. In the light of the aforestated developments, it is too late in the day for the petitioner to seek transfer of the investigation in the case to the CID.

The writ petition is therefore rendered infructuous and is accordingly dismissed.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
