THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4383 of 2016 ORDER:

This Criminal Petition is filed by the petitioner-sole accused seeking to quash the proceedings against him in CC No.32 of 2016 on the file of the Judicial Magistrate of First Class, Punganur, Chittoor District.

Heard and perused the material available on record. The petitioner is alleged to have committed the offences punishable under Sections 120-B, 323 and 420 IPC. The main ground raised by the learned counsel for the petitioner is only in connection with the offence punishable under Section 420 IPC whereas the petitioner is also charged for the offences punishable under Sections 323 and 120-B IPC. The truth or otherwise of the allegations against the petitioner can be decided during the trial of the case. Hence, this Court is not inclined to quash the proceedings against the petitioner.

Accordingly, the Criminal Petition is dismissed. Miscellaneous petitions pending, if any, shall stand closed. _______________ RAJA ELANGO, J March 30, 2016.
