THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.34610 of 2015 ORDER:

The grievance of the petitioner was that the police authorities, respondent Nos.1 to 3, were not taking steps to enter the age of the petitioner's uncle, a life convict by name Pothuganti Balaiah, as per the Age Determination Certificate issued by the Rajiv Gandhi Institute of Medical Sciences, Kadapa.

Learned Assistant Government Pleader for Home informed this Court that under Memo No.Rc2/16-AP/2014-2 dated 23.08.2015, the Director General of Prison and Correctional Services, Andhra Pradesh, Hyderabad, rejected the request of the petitioner to alter the age of his uncle and directed to produce a proper certificate of age issued by the competent Court as the department had no power otherwise to alter the date of birth.

In the light of the afore-stated rejection, the cause in this writ petition does not survive for consideration.

The writ petition is accordingly closed leaving it open to the petitioner to avail remedial measures, in the event he is aggrieved by the Memo dated 23.08.2015 addressed to him by the Director General of Prison and Correctional Services, Andhra Pradesh, Hyderabad, in accordance with law.

Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
