HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No. 13515 of 2016 Order:

The petitioner claims that she belongs to BC-B Community and passed SSC in March 1996. She is now a Graduate and PostGraduate from Kakatiya University. She was married to one K. Kumara Swamy on 28.05.2006 who was appointed as Contract Junior Lineman on 03.08.2011. There is a scheme for appointment on compassionate grounds even in the cases of Contract Junior Linemen as stated in Memo dated 26.08.2013. The petitioner's husband died in a road accident and the petitioner submitted an application seeking appointment on compassionate grounds on 08.06.2012. When her case was not considered, she filed the present Writ Petition.

A counter affidavit is filed stating that the Memo dated 22.11.2013 was issued only in relation to sanction of annual increments and regularization of Contract Junior Linemen recruited in the year 2011. The CPDCL, Hyderabad, issued Memo on 15.12.2009 directing the Superintending Engineers to examine the issue of providing the employment to the dependents of Contract Junior Linemen where fatal accidents have occurred departmentally, but since the petitioner's husband died in a road accident and not while performing the duties in the Distribution Company, the case of the petitioner was not considered. Accordingly, orders were passed on 26.09.2013 rejecting the petitioner's case.

When this case is taken up for consideration, learned counsel for the petitioner brought to the notice of this Court a settlement arrived at in the Chambers of Hon'ble Minister for Power with the representatives of Unions to provide employment to the dependants of all the deceased Contract Junior Linemen recruited vide notification issued in 2006.

In view of the same, this Writ Petition is disposed of with liberty to the petitioner to submit a fresh representation and the respondents shall review their decision dated 26.09.2013, in the light of the settlement arrived at and communicated in letter No.Jt.Secy/AS(PerI)/PO(IR& Reg.)/JPO/359/14, dated 12.07.2016, and pass the orders within a period of three (3) months from the date of representation from the petitioner.

5. The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

6. As a sequel thereto, the miscellaneous applications, if any, pending in this Writ Petition shall stand closed. ________________________ A.
