HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.8868 of 2012 ORDER:

This Writ Petition was filed challenging the final eviction notice dated 15.03.2012, issued by the Estates Officer of the Greater Hyderabad Municipal Corporation (GHMC), asking the petitioner to evict shop No.50, situated at Cellar floor of Municipal Complex, Abids, Hyderabad, and handover vacant possession within 24 hours. Though this Court, by order dated 29.03.2012, granted status quo with regard to petition schedule shop, learned standing counsel appearing for the respondent - Corporation submits that, pursuant to the orders of Lokayukta dated 04.09.2010 and 13.02.2011, directing eviction of unauthorized occupation of the lessees in respect of the shops in the Municipal complexes, notice was issued to the petitioner, who sub-let the shop to some third party, as well as to the third party. Pursuant to the said notices, the petitioner and the third party were evicted from the shop and the shop was taken possession by the respondent - Corporation.

In view of the said statement, nothing survives for consideration in the present Writ Petition.

Accordingly, the Writ Petition is dismissed as infructuous. This order will not preclude the petitioner from

applying for fresh lease in any of the shops owned by the respondent - Corporation.

Miscellaneous applications, if any, shall also stand disposed of. No order as to costs.
