THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.36821 OF 2018 ORDER:

This writ petition is filed under Article 226 of the Constitution of India, seeking to issue writ of mandamus declaring the action of the respondents in not considering the case of the petitioner for regularization of service as Operator though he has been working from 01.08.2006 to 31.03.2017 while regularizing the services of those who have worked for less than 2 years and not disposing of the representation of the petitioner, dated 03.08.2017 as arbitrary, illegal and violative of Article 14 and 16 of Constitution of India and consequently direct the respondents to consider the case of the petitioner for regularization of his service as Operator.

Heard Sri B.M.Swamidass, learned counsel for petitioner and Sri R.Vinod Reddy, learned standing counsel for the respondents.

It has been contended by the learned counsel for the petitioner that the petitioner was appointed as Operator during 2006 as an outsourcing person and was working at 33/11 KV Pargi Sub-Station and he was continued up to 31.03.2017. The grievance of the petitioner is that juniors of the petitioner those who have not completed minimum 2 years of services were regularized. Therefore, he submitted a representation, dated 03.08.2017 to consider his case for regularization on par with other similarly situated persons. But, the respondents have not passed orders on the said representation. It is further contended that the said representation be directed to be disposed of.

Learned standing counsel for respondents had not disputed the above said facts and contends that the case of the petitioner will be considered in accordance with rules. 5.

In view of the submission made by the learned standing counsel for respondents, this Court is of the considered view that the writ petition can be disposed of at the stage of admission directing the respondents to consider the representation of the petitioner, dated 03.08.2017 and pass appropriate orders within a period of 4 weeks from the date of receipt of a copy of this order.
