THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT APPEAL No.7 of 2015 JUDGMENT: (per the Hon'ble The Chief Justice Sri Kalyan Jyoti Sengupta) This writ appeal is dismissed summarily as we are of the view that the order passed by the learned Single Judge is not an appealable one, by reason of the fact that the order for payment of costs is a discretionary one. We don't see that the discretion has been exercised harshly or arbitrarily. Indeed, there is no such ground to impugn the order. No order as to costs.

Consequently, miscellaneous petitions, if any pending, shall stand dismissed.
