THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION NO.16951 OF 2016 ORDER:

This petition is filed under Section 482 of Criminal Procedure Code (for short "Cr.P.C.") to quash the proceedings in Crl.M.P.No.2699 of 2016 in C.C. No.643 of 2009 dated 05.12.2016 on the file of VIII Additional Chief Metropolitan Magistrate, Nampally, Hyderabad.

The order dated 05.12.2016 concluded with just few words which reads as under:

"Accused absent. Petition dismissed."

It is apparently evident that the order is cryptic and bereft of any reasons.

Hence, the order in Crl.M.P.No.2699 of 2016 in C.C. No.643 of 2009 dated 05.12.2016 on the file of VIII Additional Chief Metropolitan Magistrate, Nampally, Hyderabad is set-aside and remanded the matter to the concerned Court to decide the matter by well-reasoned order.

With the above direction, the criminal petition is allowed. Consequently, miscellaneous petitions, if any, pending in this Petition shall stand closed.
