Petitioner No.2 is the owner of premises bearing Nos.3/1165 to 1169 of YMR Colony, Jammalamadugu Road, Proddatur, YSR District.

Petitioner No.1 is a tenant of the said property and has been carrying on a dental clinic therein. The cause for the petitioners to file the present Writ Petition is that respondent Nos.1 and 2 have been trying to lay a road by removing a part of the aforesaid property without following the due process of law. They have alleged that markings on the said property have been made unilaterally and that so far, legal process has not been set in motion for acquiring the same.

Mr.Md.Saleem, learned Standing Counsel for respondent No.1Proddutur Municipality, on instructions, submitted that as there is imminent necessity for widening the road due to traffic congestion, respondent No.1 has embarked upon a plan for such widening and that since lot of private properties including that of petitioner No.2 are likely to be affected in the road widening, a meeting with all the owners of the private properties is being planned by respondent No.1 in order to convince them to agree for parting with their properties. He

has further submitted that till negotiations are held and consent of the owners is obtained or the properties are acquired in accordance with law, no part of the private property of petitioner No.2 will be affected.

The above submissions of the learned Standing Counsel for respondent No.1- Proddatur Municipality are placed on record and the Writ Petition is, accordingly, disposed of.

As a sequel to disposal of the Writ Petition, WPMP.No.1001 of 2016, filed by the petitioners for interim relief, is disposed of as infructuous. ______________________ (C.V.Nagarjuna Reddy, J) Dt: 7th January, 2016 lur
