This appeal is appeal is filed against the order dated 25-082015 passed in IA No.1013 of 2015 in OS No.584 of 2015 by the IX Addl. Chief Judge, City Civil Court, Hyderabad, dismissing the said application filed under Order 39, Rule 1 and 2 r/w.Section 151 CPC to grant ad-interim injunction restraining the 2nd respondent-Shri Ram Chits Private Limited, Hyderabad, from disbursing the chit amount to 1st respondent under Chit bearing no.3381/82009/18, pending suit.
2. When the matter is taken up for hearing, learned counsel for the appellant-plaintiff stated that cause in the appeal does not survive for adjudication as the chit amount has been disbursed to 1st respondent and, therefore, he may be given liberty to amend the plaint of the suit. Recording the submission made by the learned counsel, the appeal is dismissed as having become infructuous granting liberty to amend the plaint, if so advised, and in any case, if such an amendment of the plaint is sought, the same shall be dealt with in accordance with law.
