THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.46320 OF 2016 ORDER:
The writ petition is filed by the petitioner seeking a writ of certiorari by quashing the proceedings in crime No.149 of 2016, which is registered for the offence under Section 332 IPC on the file of the third respondent, against the petitioner in view of the compromise between the petitioner and the fourth respondent.
Heard the learned counsel for the petitioner and the learned Public Prosecutor and perused the material available on record. Learned counsel for the petitioner submits that the petitioner entered into compromise with the de facto complainant/fourth respondent and they settled the dispute between them. The fourth respondent also asserted that they have entered into compromise.
In view of the above submission and also in view of the fact that the petitioner is a Government servant, the proceedings in F.I.R.No.149 of 2016 on the file of the third respondent against the petitioner, is hereby quashed. The writ petition is accordingly allowed. Consequently, miscellaneous petitions, if any, pending, shall stand closed. _____________________ JUSTICE RAJA ELANGO 02.01.2017 pln
