THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR CRIMINAL PETITION No. 4206 of 2016 ORDER:

The present application is filed, under Sections 437 and 439 of Criminal Procedure Code, seeking enlargement of the petitioner on bail in Crime No.03/RCT-CIU/AP-HYD/2016 of ACB, CIU, Andhra Pradesh, Hyderabad, registered for the offences punishable under Sections 7, 13(2) r/w.13(1)(d) of Prevention of Corruption Act, 1988.

2. The case of the prosecution is that the petitioner is alleged to have demanded an amount of Rs.3,00,000/- to waive the Cess Demand Fees, as illegal gratification other than legal remuneration. The petitioner was arrested on 20.03.2016. An application for bail was moved before the trial Court immediately thereafter which is pending. It is further submitted that an application vide Crl.M.P.No.162 of 2016 seeking interim bail was filed on the ground that petitioner's younger brother's daughter marriage is scheduled to be held at Proddutur, Kadapa District, on 24.03.2016 at 08.47 p.m. and that his younger brother is an insane person. It is said that the petitioner has to perform the Kanyadanam and other rituals at the time of marriage.

3. The Special Standing Counsel for SPE and ACB strongly opposed the application contending that the marriage is not of his brother's daughter and it is of his distant relative. Even otherwise, he submits that friends of the petitioner are threatening the informant and others to settle the matter. Since 164 Cr.P.C. statement is yet to be recorded and having regard to the facts and circumstances of the case, I am not inclined to grant bail, but, since the marriage is that of a close relative of the petitioner, he shall be released on escort bail from 4.00 p.m. on 24.03.2016 to 5.00 p.m. on 25.03.2016 on his executing a bond for Rs.10,000/- (Rupees ten thousand only) with one surety to the

satisfaction of Superintendent, District Jail, Kurnool. The petitioner shall surrender himself before Superintendent, District Jail, Kurnool on or before 5.00 p.m. on 25.03.2016. The costs for providing Escort and other miscellaneous expenditure shall be borne by the petitioner. It is needless to mention that the Superintendent, District Jail, Kurnool shall provide escort to that effect.

With the above direction, Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in the present case shall stand closed.
